These are defined in compliance with the ‘best interests of the child’ principle, which is a child-rights principle derived by the UN. Some of the most influential factors within this principle which are considered when deciding on child custody include; the child’s existing and evolving skills, their identity, including age, gender and personal history, and the child’s development potential and their gradual transition into adulthood and an independent life. All of these factors are carefully considered, being specific to each individual case, before the judge decides what form of custody is best suited in the interest of the child.
